Policy 114: CSUS Alcohol and Drug Policy

Board Policy

In order to ensure a safe environment conducive to education, research, and service for students and employees, the Board requires all institutions and entities under its jurisdiction to promulgate policies, rules, and regulations to prevent the misuse or abuse of alcohol and to prohibit the use of illegal drugs. The following policies shall guide the institutions of the Board:

  1. Alcohol. The age for legal possession and consumption of alcohol in the State of Colorado is 21 years of age. State law regarding use of alcohol shall be followed by the Board and all institutions and entities under its jurisdiction.
  2. Drugs. The Board expressly prohibits the unlawful manufacture, distribution, dispensation, possession, or use of controlled substances and illicit drugs on Board property or in connection with any institutional activity, including work. Institutions of higher education are required under the Drug Free Workplace Act of 1988 (41 USC § 701 et seq.) and the Federal Drug Free Schools Committees Act Amendment of 1989 (See: 34 CFR 86.1 et seq.) to adopt policies with specific provisions that prohibit the manufacture, distribution, possession, and use of illicit drugs in the workplace. The Board requires adherence to these proscriptions by all of the institutions it governs.
  3. Amendment 64 and Marijuana possession or use. In 2012, the Colorado voters approved an amendment to Article XVIII of the Constitution of the State of Colorado by adding a new Section 16: Personal use and regulation of marijuana (Amendment 64). Paragraph (6) of this amendment permits employers and schools like the Board to prohibit or otherwise regulate the possession, consumption, use, display, transfer, distribution, sale, or growing of marijuana on property owned or controlled by the Board.
  4. Despite the passage of Amendment 64, the possession and use of marijuana is still prohibited under federal law (See: 21 USC §§ 841 (a)(1), 844 (a).

Procedure

  1. Each institutional president shall implement policies and procedures consistent with this policy and the law.
  2. The Office of General Counsel periodically reviews these policies to ensure compliance with the law.
